Topic Title: HSBC Yamaha, charged for extra ATV, not resolved.
In May 2003 we purchased two ATV's from Capital Yamaha Sacramento CA. We were never told that when we applied for financing that we were in fact applying for an HSBC credit card. We were not aware of that fact until we received our first bill in June 2003, which was wrong. The bill showed the purchase of three ATV's not two. Two on May 17,2003 which was correct and one on May 18, 2003 which was incorrect.
The bill then showed one of the ATV's from May 17 removed. By crediting the purchase on two separate days it allowed HSBC to collect extra finance charges they were not entitled to collect. We notified HSBC and the dealership of the mistake and were told by HSBC that the problem would be corrected. When we received our bill in July 2003 the problem had not been corrected and on top of that, we were charged three sets of finance charges on two bikes. Again we called HSBC and were given one line of BS after another.
That’s when we began writing letters disputing the charges. We have been waiting over two years for a response. We sent certified letters to the customer service department and the legal department and still no response.
There are also several other bogus charges on the account that we have not been able to get resolved. We became so sick of the bogus charges and fees building up, we returned to bikes only to have them sold well below the blue book value (which we have been told is illegal in the state of California). Now they are demanding payment in full. This includes fees and items that are still in dispute. We are at a loss as to what to do next or where else to write. I cannot afford an attorney to fight them anymore. Is there anyone we can contact for help?

B.R., it's tough to determine exactly what happened from reading your post. However, it sounds like the dealer accidently put through 3 sales instead of 2 (yes, the dealer actually processes the sale). From that point, it sounds like you believe HSBC didn't credit back the full amount when they removed the sale, then you ran into other issues. You sold the units, and now HSBC wants the balance paid. 1st question: What did you do with the money when you sold the units? If you used it to pay down the balance, great. If you are sincere about getting this resolved, and you honestly have made every effort with HSBC's customer service, try calling Yamaha directly. They should be able to work with HSBC to determine the facts on your account and correct any errors.

We monitor customer trends for possible violations of Regulation Z and other possible illegal actions.
