About 3 years ago I went to a dealer to look at cars..Found one we were interested in... so the dealer ever pushing for me to fill out a credit app..took down my information and checked my credit..but the deal fell threw on the car they had just got it in and needed 3 days to go over it.(I NEEDED A CAR NOW) so i went to another dealer and bought a new car....well the first dealer submitted the loan with HOUSEHOLD and waited two weeks for the money to be funded...then called me and said your car is ready!! i called household and couldnt hardly talk to anyone. they just said you owe us the money (repoed car at the dealer)(I NEVER HAD CAR)...finally after weeks of phone calls the put me in contact with their fraud and investigations dept..headed by Mr NICK DAMATO....he sent me the app that was submitted by the dealer....first of all they miss spelled my last name, had wrong work place, NEVER verified Insurance on the car..AND it wasnt my signature....So i submitted a handwriting analysis...didnt hear back from them for Months.(NOT FROM MY NEGLECT...I called NICK 30 times) So one day i tried to call Mr Damato same answering machine but it said if your hsbc employee press 3 so i did...haha...it was his pager number so i paged him...He then called me back unknowing it was me...He said Yes we sent you papers saying the loan was found to be fraudulent...(BUT I NEVER RECEIVED ANY) and he promised it would be removed from my credit report....So i took him at his Word WOW what a mistake that was!! Now HSBC still shows repo on my credit report...and they sold the loan to a collection agency
MIDLAND CREDIT MGMT Guy calls here from Midland saying i owe them 6000.00 ...i tried to explain to him...but he said sir i really dont give a ^$%# you owe us the money its on your credit now pay it...HSBC has 2 hits on my credit report and now midland does knocking me from 670 to a 530...i disputed both with the big 3 but BOTH HSBC and Midland responded...im lost on what to do now....ive called nick damato over and over...now he wont answer....and they say nobody else can help me If anyone has any ideas PLEASE let me know!!

Wow, where to start.

Report the car dealership to the FTC and the local BBB. You did not sign the documents, or take delivery on the car. Sounds as if they had every intention of unloading a lemon, even if it meant selling it straight into repossession (at your expense).

Contact Midland, they are in violation of the Fair Debt Collections Practices. Request a Do not call to your cell phone.

Try to establish an audit trail of the people you have talked with in the past. If you have notes, include names, dates, telephone numbers.

Try to get all correspondence in writing with HSBC.

Report all parties to the Federal Trade Commission and the office for your state attorney general.

Report HSBC to the OCC for violations of Fair Credit. A toll free number for the OCC (Office of the Comptroller of the Currency) is 800-613-6743.

The squeaky wheel gets the grease, and it sounds as if the squeaking needs to begin. Make noise to anyone you can think of, local news, law, regulation offices.

The bad part of your story, is that any bid or estimate whether declined or performed will be a part of everyone's risk in the future.
