Topic Title: Check cleared for $400, posted $4 to account

My son was out of work for end of 2004 and I started making payments after the 4-6 a day harassing phone calls from HSBC. I have been sending on time (most time early) $400.00 since 12/04. I started this when I was out of work due to cancer surgery and they kept calling and this was my way to stop them.

June 15, 2005 I sent a check that was written in subject line Four and no/100 and $400.00 put into amount field. My bank paid HSBC $400.00 but of course this loanshark company has only posted $4.00. I have been trying to get this resolved since 7/5/2005 and still making payments on time. After 36 years of marriage with good credit I have never encountered anything like this. I worked in Sears Collection for 2 years and was taught to never talk to people the way they are calling my home number.

My son works all hours and is not usually here. Tonight since 5pm they have called 4 times and it is just 9pm EST. They have been faxed 4 times and today I sent the behind amount to keep them from calling but I am afraid I am out $396.00. I would love to have an address to mail info so that I can have a signed receipt since they are not responding to any backup showing the payment and that they have $396.00 sitting in their Bank of America account. One India girl asked “how were they suppose to find it”? They will not give out an address. Any suggestions you can give is greatly appreciated. I intend to write a letter to our editor in local paper advising against them.

Use the address for complaint resolutions and write a letter to your bank and HSBC. Explain the inconsistency with the amount the check processed through your checking account and the amount that was credited to your account.

You will need to provide photocopies of the front and back of the check, a bank statement that verifies that $400 was deducted from your account.

There is the possibility that your bank is holding the $396. Either way the matter needs to be resolved before the time limit expires to make the correction.
