JS in Maryland sends this update: “The saga continues. Got a 2 page letter from Theres A. Nicchia, vice president, Customer Resolution Department at HSBC. The second paragraph is full of inaccurate statements such as the amount borrowed was $329,806.31 ( when it was really $324,998.24 at an interest rate of 8.44). This amount was also verified by another employee of HSBC. The letter also states a modification agreement was executed (never heard of that)
The letter also states how the collection department maintained consistent contact with us. (Wrong, we were the ones always calling them! They also deny being contacted by a third party regarding a short sale.
These people do not take any responsibility for anything. Can someone please tell me whether HSBC would have knowledge of a second mortgage on the property? To me it would go without saying that the first mortgage would know about the second. But HSBC swears they knew nothing.
The letter also states that the foreclosure sale will resume on January 9, 2009. Our investigator from the Financial Regulators office is on vacation until after Christmas, so I’ll have to wait to get her input on this. Any thoughts would be appreciated.”
