KC in Kansas said: “4 years ago my husband lost his job and we fell 2 months behind in our mortgage. HSBC then began foreclosure proceedings. We filed a Chapter 13 to stop the foreclosure. We have never been late on payments since and we received our completion papers on Nov.12, 2008. On Nov. 12, 2008 HSBC sends a statement saying we are two months behind on our mortgage! I call and they tell me “ALL” our checks have been posting to two months previous to make up for the very beginning. These two months were in the arrears of the mortgage! So now we had to call our lawyer and have our case re-opened! Chapter 13 does not stop these people from taking your homes! We are currently waiting to see if the judge will allow us to reopen the case. Our lawyer says not to worry and that the court may very well impose fines on HSBC. I can only pray!”
