CF in Connecticut sends a welcome, well written, detailed follow-up to his ongoing battle with HSBC:
“This another follow up to the on going battle with HSBC regarding my mortgage. AS I stated in earlier posts my loan has been found and verified to be in violation of Truth in Lending, RESPA and HOPA. HSBC has further violated the law by refusing to comply with 3 not one but 3 valid and legal Rights To Rescind.
BY HSBC failing to comply and the fact that the loan does not comply with rules clearly established under the afore mentioned laws and adding to it the complete lack of compliance with the laws, I have been contacting speaking with several state and federal agencies.
To date I have met with and or spoke to the following;
The, Banking Commissioner for the State of Connecticut.
Attorney Generals Office for the State of Connecticut
Chief States Attorney’s Office, State Wide Prosecution Unit
Assistant US Attorney in Hartford
OCC, Treasury Department
Federal Trade Commission
The above after reviewing documents from my loan stated that the loan as written fails to meet federal rules and as such is in violation and thereby is subject to fines and penalties as allowed by law. Also after receiving the Right To Rescind ( on three separate occasions) and by failing to comply to said notices not only violated the law but by action of the law caused the security interest in my property to be removed and negated the rights of HSBC to receive any additional payments. By failing to comply the process of rescinding became automatic and the note became null in void.
Since HSBC still thinks that the laws in country only apply to it in regards as to how they apply it to its customers when demanding payments and foreclosing.
Well it seems that this will be coming to end shortly. The reason I make this statement is that HSBC and other banks are now under investigation by the FBI. 480 Agents have been assigned by the justice department to investigate the sub prime lenders, HSBC among them.
Recently I have been in contact with the Chicago office, the Tampa office, the New York office and the New Haven Office of the FBI regarding HSBC. Chicago Office is were HSBC Financial office is located, Tampa is were HSBC Mortgage Services Operates, the New York Office being the main office conducting the investigation and the New Haven Office being my local office. It has been stated that the investigation will include all levels of personal. That is the from upper management to lower level employees will fall under this investigation and any wrong doing by these individuals will result in action being taken. And when asked, I will supply the names of all individuals I have had the displeasure to deal with along with all faxes, letters and memos sent by them. To date I will as requested send all loan documents as well.
In regards to actions taken on my part, I am now in discussions with one of the most prominent laws firms in Connecticut and will begin actions in federal court seeking unspecified damages. These damages will include but will not be limited to statutory fines and penalties, and punitive damages. I gave HSBC the chance to settle this issue on several occasions. HSBC in its arrogance has stated that it will not comply or for that matter settle for any thing less than me giving the money or taking my home.
Well it seems that there is justice out there. It is hoped by the level of attention now given by federal regulators and investigators that HSBC will fall. Those responsible will go to jail. So I hope that my complaining to various agencies and fighting them in court will be another straw on their backs helping to bring them down.
It is apparent that the Household settlement taught them nothing. Because the Household settlement and agreements where with the Household, HSBC feels it need not comply with the agreement because it bought Household after the agreement and as such is under no way accountable to comply with the agreement.
It is requested that any and all Connecticut residents who had their loans either originated with or purchased by HSBC, Beneficial, Household etc. and is having problems with HSBC forward all complaints to the Attorney Generals office for the state of Connecticut attention Asst. Attorney General Adeyemi . Specifically, those loans originated by, Accredited Mortgage. Attorney Adeyemi was part of the legal team involved with the Household settlement, and as such is familiar with HSBC.”
