RT in Missouri said: “On 08/05/09 I called HSBC auto to cancel a postdated check they were holding, because the representative said that this was an option. I confirmed with the rep 3 times during the conversation that the payment was cancelled and would not be processed. On 08/21/09 this payment hit my bank causing 5 over draft fees and 3 returned checks, 1 not being HSBC’s payment. For 3 days I have been trying to get them to reverse the payment and am getting the runaround. In the meantime I am left to try and cover these fees and have no money. I need help”

There is no law preventing a debt collection agency from requesting a post-dated check, however, a debt collection agency is prohibited from demanding you send a post-dated check in order to prevent criminal prosecution.
Can a debt collector cash a post-dated check too soon? No, a debt collector is not supposed to cash a post-dated check before the date on the check, but don’t ever give them one anyway, since there is little you can do legally if he does cash it early!
