A California resident said: “I had an auto finance loan with HSBC Auto Finance. Like all Americans right now I had run into financial problems but, I kept in touch with the collections department regarding my financial status. I spoke frequently to Michelle . In July 2009, Michelle suggested to me to have up to 6 of my past due payments deferred and I was elated!
I was told not to make a payment. I made the requested $150.00 payment to have this deferment done and I waited for many weeks for a response. I left many voice mails with only one return call when Michelle stated that there was no response from her boss yet.
I was also told that HSBC did not want to take my car from me but to help me keep it and Michelle stated that there were many other options to assist me if the deferment did not progress and to just call her back. I asked about re-financing because I was on disability and I was told HSBC did not provide that anymore.
In mid July 2009 I received a letter that I did not get my deferment that Michelle personally called me on and that I needed to make a payment. I agreed and the week I was to get my disability check, I received a notice that I had depleted my funds and would not be receiving anymore.
I called Michelle Williams and left yet another voice mail requesting a return call on the “other options” that she mentioned and I received no call back after three more voice mails. In fact I instead got a repo woman at my door in the first week of August and they took my car.
I called Michelle Williams once again to return my call about the repo and no results. The following week I received a Fedex letter that stated that suggested I take an offer of a smarter refinance and it would lower my payment to get my car back.
I feel mistreated and HSBC was un-professional. I trusted their collector Michelle and thought that I would be able to work out a different way to keep my car like she told me but, instead, they took my car and then offered me an option in a letter.
I feel that this should not have happened this way. I was deceived.”
