SO in Montana said: “In 2003 I received a car loan. A couple weeks later a women ran a stop sign and hit my family. She totalled my car, so her insurance paid off the loan. (I have the documents to prove it.) I went in and HSBC let me get another car loan for the same price. Same car as well.
I had some medical issues from the accident and lost my job. I volunteered to get my car repossed as I couldn’t find another job etc…I ended up losing everything because of the accident.
They sold the vehicle and the balance left was $7000.00 and they wanted me to pay that all at once. I had a job but not making anything more than min wage just to support my family. I could not give them the money.
I joined the military and got back on my feet. I called HSBC and said I want to make payments to you to rectify the bill. HSBC referred me to a collection agency. I made agreed upon payments to them.
One day I did not receive the billing papers. I called and they said that HSBC took back the bill and that I needed to call them.
I did and HSBC would not speak to me. They kept sending me to an automated call center for almost 2 months. No one would call me back. I went ahead and made a 2 month payment to the address for HSBC on my credit report.
They cashed the check and did not put it towards the bill. (I have that documention)
I finally get a letter from a lawyer who passed the bar in Florida but not Montana where we live. The letter said that I am getting sued. They also added $3000.00 to my bill.
The other issue I have is that I checked my credit report and they put me down for 4 car loans and all of them are the charged off bad debt and different. If you remember in the top of this report I had one car loan completely paid off.
HSBC apparently added $5000.00 more to the loan that was paid off and are trying to come after me for that. I have disputed it to my credit reports and HSBC keeps saying that it is correct.
I have no idea where the other 2 car loans came from.
How is this legal and how do I defend myself from them and all the money they are coming after me for?
A car loan that was only $10,000 (maximum) is now around $40,000 and a bad credit score which is normally a good credit score.”
