Topic Title: HSBC Mistake But Customer Pays Dearly

AM in Kentucky says "Paid a payment online to HSBC for the normal amount due for an zero interest (12 mos) account. They notified me that the account came back as uninsufficient funds. I disputed it and got the information from my bank. My bank said that it returned the payment because HSBC inputted the check number and account numbers incorrectly. While the dispute was ongoing, they charged me late fees, return fees and interest. Wanting to not have to deal with the issue, I paid what they said was due minus the late fees and what I thought was interest. However, they kept billing me for about $300, which I assumed was the interest.

After 7 months of bills and my return calls to them, I got someone who finally saw that the collections department had never correctly credited my account. Yet, they had already notified the top three credit reporting agencies. They said that they would take care of correcting the reports to the agencies. When I discovered that they had not yet made those corrections with the agencies, they said that they were planning on doing it in August! I'm trying to get approval for buying a home now and their incorrect credit reporting is ruining my chances. Also, they sent me a letter which more or less states that I made a deliquent payment, completing disregarding my previous argument.

When I asked them about it, they said that I was the one who inputted the information incorrectly. When I asked them if they would give me a copy of the payment application I made online that shows I made the error, I wouldn't say anything further. However, they wouldn't send it to me . I told them that they were leaving me no other option than to file a suit against them and get it through discovery. They said, it was my perogative to do it! Unbelievable. I was buying a Gateway."

Editor's Note: Unfortunately your contract says you cannot sue them, cannot bring a class action against them, and agree to binding arbitration. Your state attorney general can get results, and that is your best try at this point.
